Hi Everyone, I live in Montreal currently and gave birth to my LO in Quebec as well. I moved from Toronto to Montreal. I am planning to leave the Baby father. However, I just need more informations about my rights. He abuses me mentally, financially (domestic violence). I can’t handle this anymore and I just want to seek for help and leave. I still have my place in Toronto & I will be able to move in next weekend. He has already told me several times that he doesn’t want to be in this relationship…. But always comes back to me when I try to leave. I plan to pack everything and leave leave! Please can anyone give me some advice? Thanks in advance

@Tara No, but my friend heard him last evening talking and screaming at me. She was scared about my safety.

So im not sure if laws differ I Quebec because they do usually from the rest of canada BUT when I contacted a lawyer to ask about leaving one to province to move back to my home province I was advised to not leave without custody. If the father takes you to court after you have left without being granted custody, it looks awful in the courts, and chances are you will not be granted full custody based on the fact you left without permission. The best thing you can do is documents as much as possible. Get to a woman's shelter if you're being physically abused. You have to give 90 days notice that you are leaving the father, and the father can then go to the court to file his own plea. If you do not hear from the father's lawyer on day 90, upu can legally leave the province. Make sure you have proof you provided the 90-day notice like email, text message, or both!

Be careful! Ditto reaching out to Aide Juridique, there’s also Montreal women’s centre on Saint-Urbain you can get resources/ info from. You need to have legal custody, otherwise he could take you to court/ legal issues. Hope you and baby stay safe!
