So im not sure if laws differ I Quebec because they do usually from the rest of canada BUT when I contacted a lawyer to ask about leaving one to province to move back to my home province I was advised to not leave without custody. If the father takes you to court after you have left without being granted custody, it looks awful in the courts, and chances are you will not be granted full custody based on the fact you left without permission. The best thing you can do is documents as much as possible. Get to a woman's shelter if you're being physically abused. You have to give 90 days notice that you are leaving the father, and the father can then go to the court to file his own plea. If you do not hear from the father's lawyer on day 90, upu can legally leave the province. Make sure you have proof you provided the 90-day notice like email, text message, or both!
