I think you have to pay back the first 6 weeks
You never have to pay SMP back. You might be asked to pay back any enhanced pay a company paid above SMP but never SMP.

You only return anything if they gave you something on top of SMP. So I got enhanced maternity pay to top me up to 100% salary for 9 months - I'd have to pay something back if I left. The majority of SMP they claim back from the government anyway so they've not actually paid you much if anything.
It depends if you get enhanced pay from your company. For example, I get full pay for the first 14 weeks so would have to pay back the extra if i don't return. But you don't pay back SMP
@Caroline where do you work and do they have any vacancies?!? 9 months full pay 🤯 OP - it depends on your workplace and contract but it'll never be smp you pay back. In teaching, we get 4 weeks 100%, 2 weeks 90%, then 12 weeks 50%+smp. If I don't return at all then I'd have to pay the 12 weeks worth of 50% pay back. If I return for 13 weeks or more I pay nothing back. If I return less than 13 weeks, some schools say you still have to repay all 12 weeks but some reduce it by the number of weeks returned.
I get EMP and then SMP but don’t have to pay anything back if I don’t return to work. Your better off checking your companies maternity policy or asking HR

@Bruna that's still SMP so not paid back. They've not given you anything extra, it's literally the bare minimum.

You don't have to return SMP as it's the government that pay you, not work. However, if you receive enhanced maternity pay from your company, then you may have to return it - this would be stated in your contract x
