I took two weeks off unpaid before giving birth to my baby on the 5th of august. I have another week and a half before my supposed return back to work. I put in the claim for my leave a whole month ago and the insurance company has yet to process and payout my claim.. and my husband is also on leave atm. we literally have nothing left in our names, made sure baby has everything she needs for a while but we’re stuck. they are trying to avoid payment but i’m at my wits end here and need guidance on how to go about getting my leave paid.

I been calling them for the last 3 weeks y nada. I called wednesday they said they asked the employer for additional information like how when everything was sent weeks ago

Something similar happened with my husband's PL. They had the info they needed but weren't paying out the claim. Did you in effect complete the claim by providing proof of birth? That was the last piece for us with leave. At first the insurance company said they didn't need it but then clearly they did. This is probably not helping. Just trying to think how you could move things along in a hurry. Do you have one point of contact at the insurance company or they bounce you around from person to person?

@Lisa When I faxed all of the forms I provided her birth certificate so I figured I sent everything I needed on my behalf. everything has really been between the employer and the insurance company. just last week they said they had everything they needed and this week on monday they said they needed more information from the employer and finally received it so yet again they’re saying they have everything they need. I have a designated representative who turns out to be the analyst making the determination and she only reached out once and I couldn’t answer (tending to the baby) and I have been calling for the past week they’re different people but I have her extension and she refuses to answer. my husband called for me and asked for a manager and we were just transferred to my rep. it’s a run around and I’m scared they’re going to deny because my leave is almost over. but I haven’t paid any of my bills since the beginning of my leave and I’m just stuck idk what to do to speed it up

This is beyond awful...you don't happen to live close to an office of this insurance company do you? Where your husband could go in person? Or is there someone at your employer who could advocate for you? Like get more involved on your behalf? Or you could be more assertive by asking to speak to someone in order to file a complaint, say you'll report the insurance company, threaten legal action...who knows that could do the trick. Seems drastic but some people respond to that kind of thing even though it's harsh and should be unnecessary. Also, do you know anyone from work that you trust and has been through taking leave for maternity/paternity? They could potentially know how best to navigate this. Will keep thinking of other ways you can go about this. Hang in there. Where there's a will there's a way ❤️

Another thought-do you or your husband belong to a union at work? A union rep could be very helpful

@Lisa I really do wish it was that easy…my employer was trying to tell the both of us that they only over maternity leave and that my husband is only allowed one week to bond with baby (we work in the same company). my husband did research and found that we’re covered by the hartford insurance company so that he could take his leave. since then we been waiting for my money to come in to do anything and he wanted to postpone his leave to get paid until I got my money but nobody ever got back to him and nobody has gotten back to be about returning either. they just didn’t want us to take leave so i’m sure no one will advocate in fact they been annoyed we have been reaching out so frequently to check what’s going on

So interestingly enough my husband is covered by the Hartford too. Let me ask him in the morning what he suggests. He's had multiple issues with them in the past not only with paternity leave but another type leave also when he had surgery. Took a ton of work to get anywhere and receive payment. So at the very least please know you're not alone. Hopefully he has some insight

Oh yeah, he says it was a big mess and they couldn't have been less helpful. They paid him then demanded part of the payment back? Because someone made a mistake with the amount on their end (and it wasn't a mistake--the numbers were correct). Weird. Anyway he said what worked was getting someone from the Hartford on the phone with him plus someone from his employer's office at the same time. The Hartford seemed perfectly happy to debate facts (number totals, what paperwork had been received/provided) but not debate with a rep from his employer.

He's now brainstorming on what can be done too. Can you speak in ultimatums with them? I've provided all that's required and you've had time to review it, if you don't pay me what I'm owed, then...be very very stern. It would not be in my personal nature to be this way but they're not doing their job and they're delaying something that you are legally owed and is vital in meeting your needs.

If it’s the NYPLF it’s still up to to make sure all the paperwork is in. It does take a while to come. But it will. I think I didn’t receive mine until about 2 months after she was born.

@Lisa at this point i’m thinking about asking on monday to see if everything is in or waiting for the rep to call me back to speak to her myself. there’s not much I could do anymore

Girl Hartford is so annoying but it should’ve went through already. It’s your employer that’s fucking up. Try speaking to a women named Theresa there she was so helpful with me and called my job right away and demanded everything.

I’m pretty sure you can also get your job in legal trouble for it.

Its so confusing, I had so many issues with my job, and then ultimately, it was 6-8 weeks of std through met life, 3 months fully paid of maternity through work, and then they said NY owes me money of 6 weeks of PDL, none of it ever makes sense because some companies also use insurance companies for PDL and not everyone qualifies for NYS PDL, I dk honestly, on top of that in worried about feeding my new born.

@Anela yes right and the way they do it is wild to me. I just got my claim approved right and I return back to work next monday. I would love to extend my leave as i’m going through really bad ppd but they told me I needed to request an extension two weeks before my end date but approved it a week before so I can’t even extend. sad

@Lisa They finally approved my claim after a whole month but the funny part about it is that my husband put his in last week and they approved his claim too. so I had to wait forever and his went through right away 😭

FINALLY! That's insane it took so long for you and not your husband. What a stressful production they turned it into but hey you got there!!! 👏🎉
