Can I loose SMP?

I am so stressed by this. I am a teacher and left for maternity leave. I do tutoring on the side but for a company so my pay is attached to my NI number. I did a few days of work after the baby arrived just to keep my mental strength up. My tutoring employer said she would pay me once I finished maternity leave. However, she has paid me early and now I’m scared I’ll lose my SMP? Could this happen? How can I get around it? It’s literally £100 but I’ll loose £1000s if I don’t get my allowance and have to go back early.

Could you contact HMRC and explain that you didn't realise/ claim nativity?

Are you entitled to keep in touch days with your tutoring company? You are able to be paid for up to 10 days of work while on maternity leave but I’m not sure if it’s dependent on the company or if it’s from the government. Be worth double checking!

I’m going with not saying anything and if I’m told off then will make an excuse. I’m just hoping no one notices

I’m a teacher and do exam board marking and did it whilst I was on maternity leave. I was told that because I count as a contractor and not an employee that it won’t have any impact as it’s not my main role and I’m not entitled to mat leave with them. My friend does tutoring through a company and also has had no issues. I’ve almost finished my mat leave now and it’s had no impact so hopefully you’ll be fine! 🤞🏼

You can have up to 10 KIT days. Just say it was one of those if you get questioned.
