Pregnant on Mat leave

Has anyone else fallen pregnant on maternity leave and did not return to work in between? Specifically in Canada. I haven’t contacted my work yet about it but I’m wondering can they let me go? Or will I be able to keep my position after taking an extended leave (unpaid obviously)

I think the rule is that you can take up to 18months of leave per pregnancy and that your position has to be held for you. But I don't know for sure if they can be back to back leaves. I got pregnant on mat leave but I returned to work for 4 months while pregnant so that I could hit the minimum hours for EI. If you take a second leave without working between, you won't be eligible for employment insurance pay.

Go back to work early so you can get ei next time too if money matters...I know someone that went to babytime with us did that

Happened with me. They did not extend my unpaid 18 months leave. They asked me to bring a doctors note saying that I’m unfit to work (which obviously didn’t happen). Eventually they made me quit.

@Yashna id look into that cuz I'm sure that's considered discrimination against a pregnancy

@Parveen Yes that’s true. They wanted to hire someone else, who my manager preferred and without involving the higher authorities, they made me resign without giving any option. My 7 month old that time was not going to daycare, I had no help because my family is back in India. I just had hired a nanny and I was not comfortable leaving her alone with the baby Monday-Friday, 9-5. I also asked if they could offer work from home (when most of the people in the company do), I was even willing to start my maternity leave early. But they just did not agree to anything.

@Yashna thats what shitty companies do when they don't like someone so a blessing in disguise but I'd make their life miserable with your rights regardless. Also they shouldn't ask you to come back at 7 months when you took 12 month mat leave . 12 months is the min unless YOU decide to return earlier . I have my own shit story about pregnancy. I was terminated before I told them but the word was out in the company even though I had a dr note to wfh. Someone breached privacy as it was a pharmacy and I ordered a prescription from there and they knew it was for pregnancy. How else did people know i was pregnant when I told no one? I filed complaints with the college of pharmacist and whatever else i could do but it got nowhere but at least I tried to fight for it.

@Parveen of course a blessing in disguise. My manager harassed me so I started my mat leave early and my baby was born preterm, and they wanted to meet me a little before completing one year, that’s how my baby was 7 months old that time. I tried to tell the higher authorities but they wouldn’t do much about it.

@Yashna i guess depends on the industry too like mine was pharmacy so I went to the college of pharmacists since that was a breach but otherwise employer always takes employers back no matter what. Blessing in disguise I agree but also we all need money to pay our bills and it's not easy to find a job these days.

@Parveen that’s true! Hopefully I’ll get something better soon.

@Yashna good luck! I'm still looking but my mat leave just ended but I still started in Sept (I also want hybrid/remote for a little bit of help with the kid)

Also want to add that I am due soon and I wanted to return early but unfortunately it didn’t happen, I work in an industry where I cannot do my job pregnant and finding childcare was impossible

Discrimination to be let go because your pregnant.. if they can't do it the first time then why can they the second time just cuz u didn't return?

Which state are you in?

Yeah I got pregnant the same month I was supposed to go back and was just like meh I'll just be a stay at home mum. I'm not going back just to leave again 🤣
