Maternity Pay

Does anyone know if I would be entitled to maternity pay again or would it be maternity allowance. I think itll be maternity allowance but the midwife seems to think I could get maternity pay. For context, I started maternity leave in Feb last year (2024) and stopped getting maternity pay in November. I am going back to work part time (like 15 hours or less) in February. But I am currently 20 weeks pregnant so would be looking at taking another maternity leave at the start/middle of May. Meaning I would only be back at work part time for 6 weeks or less. Does anyone have any idea if I would be getting allowance or statutory pay? Thanks ☺️

It will depend on your earnings between weeks 16-25 of this pregnancy. You need to earn at least a minimum amount to qualify for smp. If you earn less than that you’ll only be eligible for maternity allowance which will be 90% of your average pay over the qualifying period.

@N 💞 oh perfect thankyou! It will be maternity allowance then, I’d only be earning about £100 a week if that 🤦🏽‍♀️🙈

How many weeks pregnant will you be when you go back to work? If you’re 20 weeks now and earning smp that counts towards your qualifying earnings

@N 💞 my maternity pay ended in november but im still on maternity leave just not getting paid. Ill be around 26 weeks when I go back

Aren’t maternity allowance and SMP the same amount anyway (given you’ve worked/paid national insurance in the required period for both)

@Emily the first six weeks of smp is 90% of your average wage, ma is not. The full amount of smp for the remaining 33 weeks is the same as the full amount of ma, but if you’ve not earned enough you get a 90% average of whatever you send off on your wage slips instead.

I believe you should be entitled to it again as maternity leave is classed as continual service. I'd check your work policy.
