Back to work

Hi! Im nearing my end of maternity leave and don’t want to go back to work, I am thinking of quitting my job and being a stay at home mum (claiming uc) until my child is 2. Will I have to pay back any maternity pay to my job? Thanks

Hello, if your from the Uk then yes. If you went back for 3 months you won’t have to pay any back. Have a word with HR but I think you’d only pay back what’s above SMP

Don't make rash decisions, maybe consider going back on a part time basis first?

If you had enhanced Mat pay then you need to check with your HR department/contract as usually you are required to return to work for a set period of time or pay it back if you don’t go back. If you only received SMP then no you don’t have to pay any back.

Every company is different, best to check.

@Gemma only if she received an enhanced maternity pay from her company. If it was standard mat pay, then no she won't

Depends if they enhanced it. You’ll keep statutory if that’s all you got but my work enhance 6 months worth which you have to pay back the difference if you leave within x amount of time x

It depends on your contract. Also check you're definitely eligible for UC. I lost my job a few weeks before I was due to return and I don't qualify for UC or anything.

If you quit your job you won’t qualify for UC as you intentionally made yourself unemployed

@Kim UC don’t expect you to work until your child is 3 though if you’re the primary carer?

@Julie if you’re already on benefits before getting pregnant. If you have a job and quit you’ve intentionally made yourself unemployed and do not qualify for benefits
