Your annual leave will accrue on mat leave at 37.5hrs until the day you are back on your new contract. They are talking bs. When is your holiday year and how much have you taken?
@N 💞 so I used my whole lot of annual leave baring 10 hours to go on maternity leave a month early due to pre eclampsia. So currently between returning on 3rd Feb and 1st April when it renews I have 10 hours to take. What they are saying is as I’m returning on a part time contract not a full time contract I will then owe some days back to them as I’m not entitled to 25 days A/L anymore..
@Rachel 1st April to 1st April is the A/L year. I took my full 25 days baring 10 hrs to go on maternity leave a month early due to pre eclampsia. So what she’s saying is because I’m returning part way into the financial year then I no longer am entitled to 25 days so I will owe them to them..
@Elena they are actually correct as you have taken annual leave for a full time contract which technically you aren't anymore, however, the amount would be so minimal you would owe. Have you asked them how much it is?

Well you accrue 1/12 of your annual leave per month, so you accrue 2.08 days holiday a month (on your 25 day holiday allowance) so in theory, you still have 2 months left (all of feb and all of March) which you have NOT accrued so that's 4.16days you owe. However, you obviously accrue holiday on your new contract, do you know what that is?
@Elena there are calculators on the gov website where you can put in your hours to work out annual leave. That’s what I used to work out how much I’d accrued whilst on maternity leave as I was owed it when I handed in my notice. You could try that?

So up until you return to work you accrue annual leave at full time rate, then when you go back you will accrue at the part time rate, Depends on when your annual leave policy starts and ends xx But you could do a calculation to work out how much you have accrued up until you go back, and then a separate calculation from when you return part time to when the end of your holiday year is x
@Chloe so I haven’t accrued anything because I’ve taken it all. I have 10 hrs left to take. From when I go back on the 3rd Feb to the 1st April when A/L re instates I will accrue 19.5 hours so 3 days (my normal working week so I just need to minus the 10 I have already which leaves 9.5 so she will just take 9.5 hours out of my 2025/25 A/L which is 1 full day plus 3 hours. Okay I think I’ve worked it out 😂
It's a bit more complicated with days vs hours, but you will owe (approx) 4.16days but will accrue 18.2hours on your new contract throughout Feb and march

I think they are being harsh. Whilst what they are doing is accurate as you are part time as annual leave is pro-rata, I know many people who go part time ( not maternity related even) but for some reason still seem to take the same amount of full time leave. Maybe is an NHS thing and depends on how on the ball the department is.
@Linda no it’s because she hates my guts and wants me to leave 😂 she didn’t want me to return from maternity leave. She didn’t respond to one email for the full 10 months trying to arrange hours/days and KIT days. Shes changed my whole job role. She tried to not give me the hours I wanted/needed as a single mum who has to be the one to drop and pick my son off at the childminders. She’s incredibly rude to staff and her staff turn around is insane. 10 members of staff have left in the 10 months I’ve been off and it’s a TINY practice 😂 I just do not wanna go back but unfortunately haven’t found anything else suitable so far looking x
Yeah sounds awful, would definitely look at something elsewhere if you can. The worst thing is to have management not on your side at this time.
I think they are using the wrong words by saying owe. Your entitlement will go down because you work less days but you don't pay it back in any way
@Jenny I will because my contract has changed. So because I’ve taken a full years annual leave already but I’m returning in the same financial year on a part time contract I will owe 1 day + 3 hours that they will take from 25/26 annual leave x
The new annual leave hours won’t kick in until your new contract does so anything you’ve already taken is irrelevant

Looking at it very roughly, your new contract is half the hours, so your holiday allowance will half. Does 25 days include bank holidays? Or are they separate?

I thought your annual leave accrued during maternity should be worked out on the hours you worked before returning?
